AGF Give Reasons Why Sponsors Of Igbo Quit Notice Were Not Arrested

The Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN, on Tuesday, explained why the Federal Government could not arrest sponsors of the quit notice that was previously issued against Igbos residing in the northern part of the country.
Malami, SAN, said the government resisted pressure to go after leaders of the Arewa Youth Consultative Forum, after it gave due consideration to “security implications” of arresting them.
However, the AGF said the government would not hesitate to wield the big stick against anyone or group found to have engaged in any form of lawlessness in any part of the country.

Ongoing cold war between the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN, and the Acting Chairman of the EFCC, Mr. Ibrahim Magu, may frustrate the trial of more than 35 ex-governors.

It was further learnt that the rift between Malami and Magu was worsened by the AGF’s insistence that the Nigerian Financial Intelligence Unit, NFIU, must be separated from the EFCC.

FG Justify's Delay, Reasons Of Not Arresting Arewa Youths Over Quit Notice Threat

Nigeria’s Federal Government has given reasons why it did not arrest leaders of northern youth groups who ordered the Igbos of South East Nigeria to quit all 19 states in the North on or before October 1.
The government said there was no need arresting the Arewa youths since they argued being misquoted by the media.
This is coming on the heels of a more damning song in Hausa language, believed to be a follow-up to the quit notice order. The song debased the origin of the Igbos and calls for genocide against them.
The Minister of Interior, Abdulrahman Dambazau, who made this reason known at a news conference on Friday in Abuja, also argued that it was unnecessary arresting the group not minding the “arrest order” issued by Governor Nasir El-Rufai of Kaduna State.

Melaye's Recall Suit Judgement Fixed For September 11

The Federal High Court, Abuja, has fixed September 11, for judgment in a suit filed by Senator Dino Melaye, represents Kogi West, seeking an order of court to stop his recall from the Senate.
Also, the vacation judge, Justice Nnamdi Dimgba has slated September 11, for judgment in a sister suit filed by the All Progressives Congress (APC) and 12 others from Kogi State chapter of the Party, against the Independent National Electoral Commission (INEC), challenging the planned recall of Melaye.
Arguing the substantive suit, Melaye’s counsel, Nkem Okoro, urged the court to grant the plaintiff’s reliefs seeking to stop the recall process.
Melaye’s amended originating summon dated August 7, and filed same day, was brought pursuant to Sections 1(1)(3), 36, 68 and 69 of the 1999 Constitution and Order 3, Rule 6 of the Federal High Court Rules.
Standing on his processes, Okoro stated that Melaye was challenging the purported petition for his recall on five grounds. He averred that “the petitioners ought to have availed him with facts and circumstances upon which the alleged lost of confidence was based, prior to submission of the petition to INEC; “That by not giving him copies of the petitions, INEC has violated the rule of natural justice and fair hearing.”
Melaye also posited that even when the petition was submitted, the electoral body failed to give him a copy.
He equally challenged the constitutionality of required numbers of signatories to the petition in line with Section 69 of the Constitution, which requires more than half of registered voters in the constituency.
His lawyer in urging the court to uphold his prayers in the originating summon, submitted that, “majority of the signatures/signatories to the petition are non-existent, dead and forged.
He insisted that the petition was “initiated as a result of political malice, bad fate and animosity. Counsel to the second to fifth plaintiffs, Ponsak Bigun, aligned himself with submission of Okoro, and urged court to grant Melaye’s prayers.
However, counsel to INEC, Sulayiman Ibrahim, in a counter affidavit he filed on July 14, urged the court to dismiss Melaye’s suit for lacking in merit.
Also, the second to fourth defendants represented by Anthony Adeniyi prayed the court to discountenance the submissions of Melaye’s lawyer. Earlier, Ibrahim had argued INEC’s preliminary objection challenging the court’s jurisdiction to hear Melaye’s suit as presently constituted.
INEC noted that the amended originating summon dated August 7 and filed on August 8, was incongruous and grossly incompetent, having been filed contrary to Order 3 Rule 9 and Order 17 Rules 4, 5 of the Federal High Court Procedure Rules.
Counsel to INEC told Justice Dimgba that after leave was granted for amendment of the originating summon, Melaye filed an affidavit that was completely at variance with order of court without obtaining leave.
Replying on points of law, Melaye’s lawyer urged court to dismiss the preliminary objection, insisting that “the amended originating summon is in compliance with Order 3 Rule 9.”
Okoro informed the court that INEC had even responded to the summon, “and had waived his right by already joining issues.
“My Lord, his complainant about variance assuming without conceding that it is an irregularity, cannot nullify the originating summon based on the provisions of Order 51 of FHC rules. “Supreme Court has said that technicality cannot stand on the way of substantial justice” Okoro argued.
Meanwhile, in the suit filed by APC against INEC, marked FHC/ABJ/CS/601/2017, the court took arguments from the plaintiff and defence counsel, and fixed September 11, for judgment.
Adopting his originating processes, counsel to APC, Samuel Ologunorisa, urged the court to grant the reliefs sought by the plaintiff.
Ologunorisa argued that there was no counter affidavit from the defendant, insisting that one Alhaji Addy Ametuo, a litigation clerk, who failed to disclose his source of information, deposed to the affidavit.
“My Lord, this is fundamentally defective. All that was stated in the counter-affidavit was that the deponent works in the chamber of Yusuf Ustaz Usman.
However, INEC’s lawyer, Yunus Usman urged court to dismiss the suit.

Ifeanyi Uba Among The Shortlisted Anambra PDP Gubernatorial Aspirant

There are strong indications that Ifeanyi Uba, controversial oil magnate, may be the frontline aspirant to clinch the Peoples Democratic Party (PDP) governorship ticket for the November 18 Anambra election, having been successfully cleared to partake in the party’s forthcoming primary.
The PDP Anambra Gubernatorial Election Screening Committee on Friday also cleared five other aspirants while rejecting one.
The other aspirants cleared were Sen. Stella Oduah, former Minister of Aviation, Dr. Alex Obiogolu, John Emeka, Oseloka Obaze, as well as Lynda Ikpeazu.
However, Akolisa Ufodike was not cleared because he held dual citizenship.
The chairman of the Screening Committee, Mr. Adamu Waziri, disclosed this while presenting the clearance certificates to the screened aspirants at the party’s national secretariat in Abuja.
Waziri said the committee was fair and resolute in the conduct of the screening, in line with relevant provisions of the law.
He said, “the decision of the committee could be appealed. Anybody who is not satisfied with the decision of the committee should appeal to the National Working Committee or the Caretaker Committee for reconsideration.’’
Waziri noted that the decision of the national working committee or the caretaker committee would “override or confirm whatever we have done.”
Of the cleared aspirants, Ubah appears the standout personality. Firstly, as a billionaire, he boasts a significant war chest to prosecute the election and rival the state machinery-driven power of incumbency.
Also, he is no stranger to high-stakes gubernatorial election as he was one of the major contenders for the Anambra 2013 election, accumulating political capital and garnering useful experience as a result.
More so, he enjoys much brand visibility as he has dominated media coverage for good and bad reasons in recent times.
At the height of the monetary crisis in Nigeria, Ubah enjoyed much positive media coverage for offering to help the country fix its economic challenge to widespread acclaim. However, he suffered a significant dent to his reputation when he was accused of having sold petroleum products valued at N11 billion kept in his tank farm by NNPC without authorization, and allegedly converted the money to personal use.
Although he claimed he was only trying to retrieve money legitimately his from the NNPC which he said owed his company N16 billion, he was arrested and detained by the Department of State Services (DSS) over the allegations.
Ubah had only been released about six weeks after being in DSS custody having reportedly paid back N2 billion of the debt, in a case that is still pending.
Recall that the businessman had initially made public his defection from the Labour Party to the ruling All Progressives Congress (APC) shortly before the oil theft scandal blew up. What is not clear is how the rapid transition took place and whether there are legitimate questions about the authenticity of his membership of the PDP which could arise in the future depending on political developments.
Ubah will be hoping to brave the odds and try to leverage on public sympathy over what is perceived in some quarters to be some level of calculated persecution against him, as he seeks to shake up the politics of Anambra State in the build-up to the much-anticipated election, and eventually emerge victorious.
It remains to be seen though how exactly he will achieve this difficult but by no means improbable goal.

Jungle Justice - Another Suspected Ritualists Burnt By Angry Mob In Lagos

Angry mob yesterday stormed a den of suspected ritualists at Ile-Zik area of the old Lagos-Abeokuta expressway in Lagos State, in search of members of alleged killer gang.
At the end of the search, which, according to sources, started around 7:00a.m., two suspects were set ablaze.
Sources said the victims were lynched on the suspicion that they were members of a ritualist gang operating in the place and selling human parts to highly placed persons in the society.
Armed mobile policemen from the Lagos State Command Headquarters and operatives of the Rapid Response Squad (RRS) have since been drafted to the area to ensure that normalcy was restored to the area.
Pandemonium broke out on Thursday morning when news of the alleged discovery of yet another ritualist tunnel at Ile Zik Bus-Stop spread round the metropolis like wild fire.
The tunnel, which was uncovered by residents of the area, according to witnesses, was inhabited by some persons of questionable character.
Following the shocking discovery on Thursday, angry residents, armed with dangerous weapons, trooped to the area yesterday in search of more members of the gang.
Although the Lagos State Police Command had earlier dismissed the claim of the discovery another ritualists den at the spot, saying those found residing in the secluded area were destitutes, witnesses alleged that they saw some human parts among items recovered from the area by the Police.
The crowd, spoiling for the blood of the two suspects found inside the den by the Police and the alleged recovery of human parts on Thursday, yesterday set plans in motion to lynch anybody found hiding in the place.
It was gathered that based on this suspicion, some hoodlums had converged at the scene as early as 7:00am in search of the remaining members of the gang.
The group, numbering over 20, stormed the place and was said to have discovered some people still living inside the hideout.
An eyewitness said: “Two persons who were found to be sleeping in the area were dragged out and set on fire before the Police arrived.
In an attempt to rescue the suspects, Policemen from RRS fired canisters of tear gas into the air to disperse the crowd. The remains of the suspects have been removed by the Police.
The eyewitness said the hoodlums were reacting to last Wednesday’s discovery of another tunnel where ritualists hide to perpetuate their evil acts at Obadeyi Bus-Stop in Ijaiye area of the state.
The news, which first made the rounds on the social media, had claimed that the scene at Ile-Zik was the hideout of ritualists and had two suspects hiding inside.
The news also claimed that the two suspects arrested by the Police on Thursday were in possession of an iPhone, even though they looked sane until residents accosted them and they began to act like mentally deranged persons.
Immediately the news of the lynching of the two persons broke out, the Commander of RRS, Tunji Disu, and other Police officers stormed the area, with a view to rescuing the suspects.
They arrived late, as they watched the charred remains of the deceased lying by the roadside, but their prompt response restored normalcy in the area.
A mammoth crowd had gathered around the Expressway to catch a glimpse of the bodies of the deceased, thereby hindering smooth vehicular movement.
Meanwhile, the state Commissioner of Police, Fatai Owoseni, while reacting to the lynching of the suspects, said the Command had in the past few days, recorded incidents of jungle justice across the state and in the course of discharging its constitutional responsibilities and preventing the barbaric act, Police officers were fatally wounded, while stones were hurled at them, as well as the Police patrol vans.
Owoseni said: “There is no justification for jungle justice on suspected persons. It is barbaric and uncivilised. It is a manifestation of the erosion of our moral values and a disregard to sanctity of human lives. It violates the rule of law and dents the image of the State.
“Above all, it is a violation of the law and all those arrested in connection with the aforementioned cases will be made to face the full wrath of the law.
“The public is advised to report any suspicious happenings in their areas to the Police and other security agencies. The public is assured of the renewed commitment of the Police and other security agencies to prompt response to such reports.”
“The public is also assured of renewed synergy amongst the institutions saddled with criminal justice administration towards ensuring quick dispensation of justice.”
The Police boss warned the public to desist from this unlawful and barbaric act, as no effort would be spared in ensuring that lawful means are used to bring to justice to anyone who violates the law.
